These Provider Terms and Conditions ("Agreement") govern the relationship between MATCHARENT LTD ("MatchaRent," "we," "us," or "our") and the rental provider ("Rental Provider," "you," or "your") who lists rental apartments ("Units") on the MatchaRent website (matcharent.com).
By listing your Units on MatchaRent, you agree to comply with and be bound by these Terms and Conditions.
2. MatchaRent's Services
MatchaRent operates an online rental marketplace that connects Rental Providers with potential tenants/customers.
We provide a platform for listing your units and for potential tenants/customers to browse and enquire about them.
3. Listing Your Units
You confirm that you have the legal right to rent out the Units listed on MatchaRent.
You are responsible for the accuracy of all information provided to MatchaRent about your company and your Unit listings.
Edit requests can be sent to info@matcharent.com or your MatchaRent contact.
Listings will be standard listings unless the Featured Listing feature is purchased.
You acknowledge MatchaRent has the right to alter information provided.
MatchaRent reserves the right to remove any listing if the Provider Terms and Conditions are violated or the listing deemed inappropriate.
4. Use of Your Content
You grant MatchaRent a non-exclusive, royalty-free license to use content including, but not limited to, your company name, company information, logo, images, listings, website information, and social media content, for marketing, promotional, and advertising purposes.
This includes but is not limited to website display, social media posts, printed materials, and presentations.
5. Reviews and Testimonials
You agree that MatchaRent may collect and publish reviews and testimonials from you, the Rental Provider, about your experience with MatchaRent.
You agree that MatchaRent may collect and publish reviews and testimonials from current or past tenants/customers and individuals who have interacted with your Units or services.
You grant MatchaRent the right to publish these, including the reviewer's name, company name, job title, text, images, video, location, etc., on our website, social media channels, and marketing materials.
6. Third-Party Rights
You acknowledge and agree that MatchaRent acts solely as a platform provider and is not a party to any rental agreements or other transactions between you and tenants/customers.
MatchaRent shall not be liable for any disputes, damages, or liabilities arising from or related to your interactions with tenants/customers.
You are solely responsible for all aspects of the rental agreement with the tenant/customer.
7. Communication and Response Times
You agree to respond to enquiries from potential tenants/customers or MatchaRent within 48 hours of receiving an enquiry or a request for viewing.
8. Commission and Payment
You agree to pay MatchaRent a commission of 10% + VAT of the contract/booking value (inclusive of VAT) when a tenant/customer referred by MatchaRent signs a contract or makes a booking with you, for any booking made up to 12 months after the referral.
"Referred" in this context means transmitting tenant / customer information (e.g. name, email address, etc) to you via email or other agreed means.
The commission is exclusive of VAT. MATCHARENT LTD is not currently VAT registered. If MATCHARENT LTD was to become VAT registered, VAT will be added to the Commission.
After a tenant / customer signs a contract with you, or makes a booking, you should inform MatchaRent within 48 hours via info@matcharent.com
MatchaRent will send over a form requesting the following information to be filled out within 48 hours. Name, Email address, Booking / Contract start date, Booking / Contract end date, Total booking / contract value (including VAT).
An invoice will then be sent to the designated email address you provided on the MatchaRent Provider Sign Up Form.
An invoice will also be sent if MatchaRent is informed by the tenant / customer they signed / booked / stayed with you.
For contracts / bookings / stays with no specific start and or end date, invoices will reflect the total annual value of the listing as it appears on MatchaRent.
The commission is payable for any length of contract / booking.
Commission is owed regardless of whether the tenant / customer has contact with you, from other sources besides MatchaRent.
The commission is payable within fourteen (14) days of the invoice being sent.
9. Term and Termination
This Agreement starts when you agree to these terms on the MatchaRent Provider Sign Up Form.
MatchaRent may terminate this Agreement at any time for breach of these Terms and Conditions.
You may request for your listings to be removed at any time, but this does not remove the obligation of paying commission if a tenant/customer has been found via MatchaRent.
10. General Data Protection Act (GDPR)
We process your data on the basis of legitimate interest, which includes promoting your Units and company, facilitating communication with potential tenants/customers, and marketing our services.
We will continue to process your information under this basis until you withdraw consent or it is determined your consent no longer exists.
We process your information in the MatchaRent Provider Sign Up Form, information in email exchanges, data from your site, social media, etc.
Data retention period: We will continue to process your information under this basis until you withdraw consent or it is determined your consent no longer exists.
Sharing your information: We do not share your information with third parties.
MatchaRent may update these Provider Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. We will inform you of any significant amendments via email to the contact person who accepted these terms. Your continued use of the MatchaRent platform after receiving such notification will constitute your acceptance of the revised Terms and Conditions.
13. Extra Services
Extra services such as Featured Listing, Company Branding, Custom Forms, will be charged at the prices listed on matcharent.com at the time you agree to sign up to them via a form.
Pricing and terms for Custom Features not priced on MatchaRent will be agreed upon in separate agreements.
MATCHARENT LTD is not currently VAT registered. If MATCHARENT LTD was to become VAT registered, VAT will be added to the Extra services pricing.
Monthly invoices will be sent to the specified finance individual. Subsequent invoices will be issued on the same calendar day as the first. If the first invoice is on the last day of a month, and the next month is shorter, the invoice will be issued on the last day of that shorter month (e.g., Jan 31st invoice means Feb 28th/29th, then March 31st).
Payment for additional services is due within fourteen (14) days of the invoice date. Failure to remit payment within this timeframe may result in the suspension or termination of said services.
These monthly services will continue indefinitely until formal cancellation is submitted. To initiate cancellation, a written notice must be dispatched via email to info@matcharent.com at least 30 days prior to the desired termination date.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
15. Entire Agreement
This agreement constitutes the entire agreement between the two parties.
